Terms of Use

Effective date: 5 November 2026 · Version 2026-11-05.2

IMPORTANT: THE APPROVED POH/AFM OF YOUR AIRCRAFT AND OFFICIAL BRIEFINGS ARE THE FINAL AUTHORITY. TAS IS A REFERENCE AND TRAINING AID ONLY AND DOES NOT REPLACE THEM.

PLEASE READ SECTIONS 2–4 (WHAT TAS IS, PILOT IN COMMAND, ASSUMPTION OF RISK), 14 (DISCLAIMER) AND 15 (LIMITATION OF LIABILITY) CAREFULLY. BY CONFIRMING THE ACKNOWLEDGEMENTS AND SELECTING "I AGREE", OR BY USING TAS, YOU ACCEPT THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE TAS.

1. Who We Are and What These Terms Cover

(a) TAS is published by Happy Skies (the "Operator", "we", "us"). These Terms of Use (the "Terms") govern your use of the TAS applications for iOS, Android and the web, the TAS website, our servers and any related feature (together, "TAS").

(b) The Privacy Policy forms part of these Terms.

2. What TAS Is, and What It Is Not

(a) TAS is an informational and educational app for pilots and passengers. It presents weather reports and forecasts, NOTAMs, aerodrome and runway data, aircraft-register information, handbook tables transcribed from a published Cessna 172P Pilot’s Operating Handbook, calculators, quizzes and a simplified simulator.

(b) TAS has no airworthiness, certification or regulatory status. It is not an approved flight manual, not an approved electronic flight bag (EFB), not avionics and not a navigation, flight-planning or briefing service. It is not endorsed by the Civil Aviation Authority of Israel, the Israel Airports Authority, the Israel Meteorological Service, Textron Aviation Inc. / Cessna, any flight school or any insurer.

(c) Content in TAS may be incomplete, out of date, wrongly transcribed, wrongly translated or not applicable to your aircraft, which may differ because of its serial number, modifications, supplemental type certificates or equipment. Where TAS and an official source differ, the official source prevails.

3. You Are the Pilot in Command

(a) You remain solely responsible for the safe operation of every flight and for compliance with the Aviation Law, 5771-2011, the regulations under it and all other applicable rules. You must verify any checklist item, speed, limitation, performance figure or weight-and-balance result against the current POH/AFM of the specific aircraft before relying on it.

(b) The following features are aids that can be wrong and must never be the sole basis for a decision: plain-language and pictorial weather, flight categories, NOTAM translations and severity colours, runway and crosswind indications, Israel-time conversions, licence, medical and currency reminders, performance and weight-and-balance calculators, aircraft-register and photo lookups.

(c) Emergency information in TAS is for reference and study only. In an emergency, follow your training, the approved procedures and air traffic control instructions.

(d) If you use TAS in an aircraft, secure the device so that it cannot interfere with the controls or distract you, do not interact with it during critical phases of flight, and comply with the rules of the aircraft operator and the authorities on portable electronic devices.

4. Assumption of Risk

AVIATION INVOLVES INHERENT RISK. YOU ACCEPT THE RISKS OF USING TAS, INCLUDING THE RISK THAT CONTENT IS INCORRECT OR UNAVAILABLE AND THAT THE APP, YOUR DEVICE, ITS BATTERY OR ITS CONNECTION FAILS, AND YOU AGREE NOT TO RELY ON TAS AS YOUR ONLY SOURCE OF INFORMATION.

5. Eligibility and Organisations

(a) You must be at least 18, or at least 16 and using TAS with the consent of your parent or legal guardian under the Legal Capacity and Guardianship Law, 5722-1962. TAS is not directed at children.

(b) If you use TAS for a flight school, club or other organisation, you confirm that you are authorised to accept these Terms on its behalf; the organisation remains responsible for the content it relies on or approves for its members.

6. Licence

(a) We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use TAS on devices you own or control, for your own non-commercial use as a pilot, student or passenger. Flight schools and clubs may use TAS for their members and aircraft.

(b) You must not copy, modify, translate, reverse engineer, decompile or scrape TAS or its data, resell or host it, remove notices, circumvent technical limits, or use it to build a competing product, except to the extent the law expressly allows.

7. Your Account

Some features require an account. Keep your credentials confidential and tell us promptly at tasaerospaceapp@gmail.com about any unauthorised use. You can export your data and delete your account at any time in the app (Pilot tab).

8. Your Content and Shared Aircraft Data

(a) You keep ownership of content you submit, such as aircraft weighing data, performance-table values and uploaded documents ("User Content"). You grant us a non-exclusive, royalty-free licence to host, process and display it for as long as needed to operate TAS.

(b) Aircraft weighing data and performance-table values you save are visible to other TAS users of the same aircraft or type. Shared data is not reviewed by us: anyone relying on it must verify it against the official weight and balance report and POH/AFM. Deleting your account removes your attribution but not shared aircraft data that other users depend on; ask us if you want it removed.

(c) You confirm that you have the right to upload your User Content, including any POH document, and that it is accurate to the best of your knowledge. We may remove any User Content at any time.

9. Third-Party Data and Services

(a) TAS relies on third-party sources, including the Israel Meteorological Service, the U.S. National Weather Service (aviationweather.gov), a public mirror of the Israel Airports Authority NOTAM service, the Israeli aircraft register published on data.gov.il, OurAirports and Planespotters.net. We do not control them and do not guarantee that they supply accurate, complete, timely or properly formatted data, or that TAS will retrieve and display it correctly.

(b) Aircraft and manufacturer names, including Cessna and Skyhawk, are trademarks of their owners and are used only to identify aircraft. Their use does not imply any affiliation or endorsement. Aircraft photographs belong to their credited photographers.

10. Free Use and Future Paid Features

TAS is currently free. If we offer paid features, they will be sold through the Apple App Store or Google Play under their terms; prices and renewal terms will be shown before purchase, refunds are handled by the store under its policy, and nothing in these Terms limits any cancellation right you may have under the Consumer Protection Law, 5741-1981. Price changes apply only to future periods.

11. Availability and Changes to TAS

We may change, suspend or discontinue any part of TAS, and may require you to install updates. We do not promise that TAS will be available at any particular time, on any device, or that its data is current. TAS is not designed for safety-critical use and must not be the sole means of performing any safety-critical task.

12. Acceptable Use

You must not: use TAS unlawfully or in breach of aviation rules; present TAS or its output as an official source or as approved or reviewed content; upload false, infringing, defamatory or malicious content; impersonate anyone; interfere with, probe or overload TAS, its servers or its data sources; or use TAS in breach of sanctions or export-control laws.

13. Intellectual Property and Notices

(a) TAS software, design, text, illustrations, the selection and arrangement of content, and the TAS name and logo belong to the Operator or its licensors. Handbook content remains the property of its rights holders. Open data is used under its own licences.

(b) Suggestions you send may be used by us freely and without compensation.

(c) If you believe content in TAS infringes your rights, write to tasaerospaceapp@gmail.com identifying the work, the content complained of, your contact details and a statement of good faith. We will review the notice promptly and may remove the content.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAS AND ALL ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING AS TO ACCURACY, CURRENCY, COMPLETENESS, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. NO ADVICE OR INFORMATION FROM US CREATES A WARRANTY.

15. Limitation of Liability

(a) TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGE, OR FOR LOSS OF PROFITS, DATA, AIRCRAFT, LICENCES OR GOODWILL, OR FOR FINES, ARISING FROM TAS OR ITS CONTENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.

(b) TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR TAS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) NIS 400.

(c) Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury where the law does not permit limitation, for fraud or wilful misconduct, or under any non-waivable provision of the Consumer Protection Law, 5741-1981, or the Standard Contracts Law, 5743-1982.

16. Indemnity

You will indemnify the Operator against third-party claims, losses and reasonable legal costs arising from your breach of these Terms, your User Content, or your use of TAS contrary to these Terms, provided that we notify you of the claim promptly and allow you to take part in its defence.

17. Termination

You may stop using TAS and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue TAS, with notice where reasonably practicable. Sections 2–4, 8, 9 and 13–23 survive termination.

18. Apple App Store and Google Play

These Terms are between you and the Operator only, not Apple Inc. or Google LLC (each a "Store"). The Operator alone is responsible for TAS, its maintenance and support, any warranty, and any claim relating to it, including product-liability, legal or regulatory compliance, consumer-protection and intellectual-property claims. The Store has no obligation to provide support; if TAS fails to conform to an applicable warranty you may notify the Store, which may refund any purchase price, and to the maximum extent permitted by law the Store has no other warranty obligation. Your licence is limited to use permitted by the Store’s usage rules. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Export Control and Sanctions

You represent that you are not located in a country subject to a comprehensive embargo and are not on any government list of prohibited or restricted parties, and you will comply with applicable export-control and sanctions laws.

20. Governing Law and Disputes

(a) These Terms are governed by the laws of the State of Israel. Before starting proceedings, please send us written notice of the dispute so that we can try to resolve it in good faith within 30 days.

(b) The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction, without derogating from any non-waivable right of a consumer to sue in the court of their place of residence or from mandatory protections of the law of your country of residence.

21. Changes to These Terms

We may update these Terms. We will announce material changes in TAS and ask you to accept them before you continue. If you do not accept, you may stop using TAS and delete your account.

22. General

(a) These Terms and the Privacy Policy are the entire agreement about TAS. If a provision is invalid, it is enforced to the extent permissible and the rest remains in force. Not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of TAS. We are not liable for delays caused by events beyond our reasonable control. Nothing creates a partnership or agency. We may give notices in TAS or by email. Your electronic acceptance is recorded and has the effect of a signature.

(b) Translations are provided for convenience; if they differ, the English version prevails unless the law requires otherwise.
